DTI WEBSITE USER LEVEL SERVICE AGREEMENT (ULSA)

Thank you for visiting the official Website of the Philippine Department of Trade and Industry (DTI).
 
The “DTI Website”, herein referred to as the “DTI Web”, is owned and operated by the DTI, Republic of the Philippines. It is provided as a service to the Filipino people and foreign entities that have existing business in the Philippines or are interested in trading and investing in the country, consumers, and the public in general. By using the whole DTI Web or parts of it through accessing information, materials, and data contained within the DTI Web, the user hereby agrees to accept the following terms and conditions contained in this ULSA.
 
Terms of Use

In visiting the DTI Web, the user agrees not to use it/any of its contents for any unlawful activity, or use it in any way that would violate any of the terms and conditions stated in this ULSA.

Intellectual Property (IP) Policy
All materials contained in the DTI Web, including but not limited to the site design, news articles, directories, photographic images, and the DTI logo are protected by copyright laws. Unless otherwise specified, all contents in the DTI Web are copyrighted property of DTI/the government of the Republic of the Philippines.
Disclaimer Regarding Accuracy of Information and Usage of Data
Visitors and users of the DTI Web are advised that information contained within the DTI Web is assumed to be accurate. However, errors can occur even with computer-generated information. DTI makes no representation regarding the completeness, accuracy, or timeliness of such information and data, or that such information and data will be error-free. Visitors are encouraged to review the official version of all documents on which they plan to rely on.

DTI is not responsible for the contents of those websites and shall not be liable for any damages or loss arising from access to those Websites. These external websites and their references to any specific commercial product, process, or service by trade name, trademark, or otherwise, do not constitute or imply endorsement, association, recommendation, or favoring by the DTI Web and the DTI.
 
Conversely, external Websites hyper linking to the DTI Web do not constitute an endorsement or recommendation by DTI for these sites and their references to any specific commercial product, process, or service by trade name, trademark, or otherwise. It is understood that when the user hyperlinks to an external site, she/he has left the DTI Web and is now subject to the privacy policy of the new site and the information collected or used on the said site.
 
All the hyperlinked sites shown in the DTI Web have passed through a predetermined screening process before being allowed to be posted in the DTI Web. This process is defined in the DTI Web Implementing Rules and Regulations supporting DTI Department Order (DO) No. 47, Series of 2004.
 
In general, other websites may link to the DTI Web with prior acknowledgment and approval from DTI. DTI must be explicitly identified and duly credited as the source of information displayed. Intrusion Detection and Security
For security purposes and constant availability of the DTI Web in the Internet, DTI uses special software programs for monitoring network traffic to identify unauthorized attempts to upload or change information or cause damage to the DTI Web. These programs collect no information that would directly identify individuals, but they do collect information that could help identify someone attempting to tamper with this Website.
 
If you use this system or DTI Web, you should understand that all activities may be monitored and recorded. Anyone using this system or Site expressly consents to such monitoring. This serves as a WARNING that if such monitoring reveals possible evidence or information of criminal or suspicious activity, monitoring records may be provided to law enforcement officials without any prior oral or written notice to the suspected user.
 
Except for authorized law enforcement investigations, DTI makes no other attempts to identify individual users or their usage habits. DTI only uses raw monitoring data for logs to determine usage trends and diagnose system or DTI Web problems.
Online Payments and Transactions
In the advent of online payments and related transactions, DTI shall safeguard the user’s personal information by using industry-standard data encryption technology designed to ensure the privacy of the user’s credit card information, name, address, e-mail, and other information provided to the DTI Web. This is to provide the user with a secure online experience within the DTI Web.
Indemnity
As a condition of the DTI Web use, the user/anyone linking to it agrees to indemnify the DTI against any and all liability, expenses — including attorney’s fees and court costs — and damages arising out of claims, including, without limitation, any claims alleging facts that if true would constitute a breach of the terms and conditions stated in this ULSA.
Jurisdiction

This ULSA is governed by the laws of the Republic of the Philippines. The user/anyone linking to the DTI Web consents to the exclusive jurisdiction and venue of the courts in Makati City, Metro Manila, Philippines in all disputes arising out of or relating to the use of this website. The user/s of the DTI Web/anyone linking to it in jurisdictions of the courts outside of the Republic of the Philippines consent to the jurisdiction of the courts in the Republic of the Philippines. Republic Act (RA) No. 8792, otherwise known as The Philippine Electronic Commerce Act of 2000, shall fully apply.

Questions, Suggestions, Comments
In the interest of improving the delivery of public service through the Web, DTI reserves the right to update or modify the DTI Web/its contents without prior notice.
 
Users are advised to forward to the website administrator at kmis@dti.gov.ph any questions, suggestions, or comments about this ULSA, as well as any complaints or notification of any copyrighted or patented materials relating to this DTI Web/anyone linking to it.
